We want every client to feel confident about paying for legal services online. This policy explains when fees paid to the Law Office of Evelyn Aimée De Jesús Rodríguez, Esq. (the "Firm") are refundable. Where this policy and your signed engagement agreement differ, the engagement agreement controls.
1. Consultation Fees
- Cancellation with 24 hours' notice or more: full refund, or you may reschedule at no charge.
- Cancellation with less than 24 hours' notice, or no-show: the consultation fee is non-refundable. One courtesy reschedule may be granted at the Firm's discretion.
- Cancellation by the Firm: if we must cancel and cannot offer a reasonable alternative time, you will receive a full refund.
2. Flat-Fee Legal Services
Many immigration matters (for example, USCIS applications) are handled for a flat fee. Flat fees are earned as work is performed. If representation ends before the matter is completed — whether by your choice or ours — the Firm will refund any portion of the flat fee that has not been earned, based on the work completed to that date, as required by the Rules Regulating The Florida Bar.
3. Retainers and Hourly Matters
Advance fee deposits (retainers) are held in the Firm's trust account and are drawn down as fees are earned and costs are incurred. Any unearned balance remaining when representation ends will be refunded to you.
4. Non-Refundable Items
- Government filing fees paid to USCIS, EOIR, the Department of State, or any court, once submitted.
- Third-party costs already incurred on your behalf (translations, expert fees, courier and mailing fees, records requests, etc.).
- Fees for work already performed.
5. How to Request a Refund
- Contact the Firm in writing using the details on our Contact Information page. Please include your name, the date of payment, and the service purchased.
- We will acknowledge your request within 3 business days.
- Approved refunds are issued to the original payment method within 10 business days. Your bank or card issuer may take additional time to post the credit.
6. Disputes
If you believe a charge is incorrect, please contact us before initiating a chargeback with your bank so that we can resolve the matter quickly. Fee disputes that cannot be resolved directly may be submitted to The Florida Bar's Fee Arbitration Program.
7. Changes to This Policy
We may revise this Refund Policy from time to time. The version in effect on the date of your payment applies to that payment.
